Welcome to Cobnect (“Cobnect Inc.,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of Cobnect’s website, web applications, mobile applications, dashboards, reports, and related services (collectively, the “Services”).
By accessing or using the Services, you (“User,” “you”) agree to be bound by these Terms and our Privacy Policy (collectively, the “Agreement”). If you do not agree to these Terms, you must not access or use the Services.
Cobnect Inc. is a Canadian technology company providing web-based tools that, with the help of AI and machine learning, help homeowners and professionals evaluate and improve residential home performance in terms of energy, comfort, and sustainability indicators and, where requested, connect with contractors, suppliers, utilities, and incentive programs. Cobnect is not affiliated with or an official representative of NRCan, EnerGuide, or any government body. Reports are not official EnerGuide ratings and may not qualify for programs requiring on-site audits.
To use Cobnect, you must: (a) be at least 18 years old (or the age of majority in your province or territory); (b) have legal capacity to enter a binding contract; and (c) comply with all applicable Canadian laws and regulations.
You agree to: (a) provide accurate and complete information; (b) maintain the confidentiality of your credentials; and (c) promptly notify us of any unauthorized access or use. Cobnect is not liable for any loss or damage arising from unauthorized access caused by your failure to safeguard your account information.
You must not: (a) use the Services for unlawful, fraudulent, or harmful purposes; (b) scrape, harvest, or benchmark the Services or reports; (c) perform load, penetration, or security testing without our prior written consent; (d) introduce malware or harmful code; (e) circumvent security or access controls; (f) use the Services for high-risk activities where failure could cause injury, death, or environmental harm; or (g) access or use the Services to build or train a competing product or model. Cobnect may suspend or terminate access for misuse or breach.
Cobnect’s scores, results, and estimates are produced using algorithms, user-supplied inputs, and a combination of public, open-source, and licensed datasets. While we strive for accuracy, all outputs are estimates only and may include approximations, incomplete information, or model assumptions.
You acknowledge that: (a) results may differ from actual performance and should not be relied upon for financial, safety, design, or compliance decisions; (b) Cobnect’s data does not replace professional advice or on-site inspection; and (c) Cobnect bears no liability for losses arising from the use of its estimates or recommendations.
Cobnect’s Services are not a substitute for: (a) professional on-site energy audits or engineering services; (b) official EnerGuide or NRCan assessments; (c) advice from licensed professionals; or (d) determining eligibility for, or applying to, rebates, loans, or grants (which may require official on-site audits or other program requirements). You use the Services at your discretion and risk.
If you purchase reports, subscriptions, or premium features, you agree that: (a) fees are due as disclosed at purchase, plus applicable taxes; (b) payments are processed by third-party processors and Cobnect does not store full card details; (c) subscriptions auto-renew at the then-current rate unless you cancel before renewal via your account settings or by contacting support; (d) prices may change prospectively with notice; (e) trials (if any) convert to paid unless cancelled before the trial ends; and (f) except where required by law or our posted refund policy, fees are non-refundable and chargebacks may result in suspension and recovery of reasonable costs.
All content, algorithms, designs, logos, software, and trademarks belong to Cobnect Inc. or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Services for your personal or internal business use only. You may not resell, sublicense, publicly post, scrape, or benchmark the reports without our prior written consent. If you provide feedback or suggestions, you grant Cobnect a perpetual, irrevocable, royalty-free license to use it freely. You may not copy, modify, or create derivative works without our written consent.
If you submit information (e.g., home data, photos, comments):
You are solely responsible for the accuracy and legality of your inputs. Cobnect is not liable for errors or losses arising from inaccurate or incomplete data you provide.
Cobnect may link to or integrate with third-party services (e.g., contractors, suppliers, rebate programs). Cobnect does not endorse or guarantee third-party content or services. Access is at your own risk and subject to their terms and privacy policies.
To the fullest extent permitted by law: (a) the Services are provided “as is” and “as available”; (b) Cobnect makes no warranties of accuracy, fitness for purpose, or non-infringement; and (c) Cobnect and its officers, employees, and affiliates are not liable for any indirect, incidental, consequential, or punitive damages (including lost profits or data). Cobnect’s total liability for any claim shall not exceed the amount you paid for the Services in the six (6) months preceding the claim.
You agree to indemnify and hold harmless Cobnect and its affiliates from claims, losses, and expenses (including reasonable legal fees) that directly result from your misuse of the Services or your breach of these Terms.
Cobnect may suspend or terminate access at any time without notice if you breach these Terms or violate applicable law. Sections on intellectual property, liability, and indemnity survive termination.
Cobnect is not liable for delay or failure to perform due to events beyond its reasonable control, including natural disasters, war, terrorism, labour disputes, internet failures, or third-party outages (e.g., AWS or payment processors). Obligations are suspended for the duration of the event.
We may update these Terms periodically. Material changes will be notified by email or in-app notice. Your continued use after changes constitutes acceptance.

Unauthorized use constitutes a material breach and may result in legal action.
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict rules. Disputes shall be resolved exclusively in the courts of Ontario, unless binding arbitration is agreed in writing.
This Agreement is the entire agreement between you and Cobnect and supersedes prior agreements. Failure to enforce a provision is not a waiver. If any provision is unenforceable, it will be limited or severed to the minimum extent necessary, and the remainder remains effective.
